Terms of Use:
The following "terms of use" apply only to the use of and purchases from SoundGate ("SoundGate") website at www.soundgate.com. The terms "you", "your" and "yours" refer to the user/customer utilizing our website to purchase services or merchandise ("Product") or to browse our website. The terms "we", "us" and "our" refer to SoundGate.
Payment types we accept online:
We accept the following forms of payment for online purchases: Pay-Pal (confirmed addresses only), or credit cards MasterCard, Visa, Discover and American Express where the billing address of the cardholder is within the USA and where the credit card issuing bank is located within the USA. For your online purchases, you may purchase multiple products in a single order, and we'll accept one credit card for each order.
We are unable to accept cash, checks, C.O.D. orders and wire transfers for any website purchases.

Shipping:
You may have your product shipped to your home or business address (PayPal to "confirmed addresses" only) via Federal Express. We ship orders on normal business days, which are Monday through Friday excluding government holidays. For our Express Air service (i.e. next business day arrival), your order must be completed before 1 p.m. Central Standard Time in order for it to ship the same day.
You assume all risk of loss for shipped Products. Order information such as billing or shipping address that is inaccurate or incomplete may result in delays. Products cannot be shipped to incomplete addresses.
All orders with a 'ship to' address that is different from the 'bill to' address are subject to additional verification. We prosecute perpetrators of Credit Card Fraud to the fullest extent of the law.

It is our company policy not to sell or ship products outside the USA.

Deliverable Addresses:
NOTICE: FED-X does NOT deliver to APO, FPO or P.O. Box numbered addresses. Therefore, we cannot ship to APO, FPO or P.O. Box numbered addresses. You will need to provide a stateside address and/or a numbered street address for SOUNDGATE to ship your order.

Order cancellations
We are unable to refund any online purchase from the time your order is placed (when you click the Submit Order button), until your Product is received by you and returned to us. If you are not completely satisfied with your purchase after receiving your Product, please review our return policy to determine your preferred method of return.

Unauthorized Online Sales
SoundGate assumes no responsibility for products purchased through unauthorized dealers. For your protection, please purchase your SoundGate product from an authorized SoundGate dealer as listed in the Dealer Locator on the SoundGate website. This ensures you¹re getting current, top-quality product, the proper application information, and SoundGate¹s leading technical support and warranties. Under no circumstances are unauthorized dealers permitted to offer an official SoundGate warranty, nor are they authorized to give application or technical information about SoundGate product.

Returns/Refunds:
SoundGate offers a 30 day replacement/refund policy (excluding shipping charges) for any item except closeout specials or non inventory special orders. Refunds may take 7 to 10 business days to process after product is received to our return facility. Improper installation or abuse is NOT grounds for a refund or warranty repair/exchange, and will be denied. If you are at all uncertain of what parts you need or what will work in your car, contact us either via e-mail at sgtech@soundgate.com or call SoundGate Technical Support Services at 1-800-256-0808 for assistance. When receiving a recommendation from SoundGate Technical Support Services it is essential that you keep all contact names and records in the case of an incorrect recommendation. If no records or names are present we will have to assume no recommendation was suggested.

SoundGate restocking fees
- 15% Standard restocking fee provided all packaging is returned and product is in perfect condition.
- 20% Standard restocking fee if packaging is missing and product is in perfect condition.
- If product is damaged in either case the product will be evaluated by SoundGate Returns department to determine appropriate restocking fee.
Details of our Returns Policies are as Follows:
- If the item is defective within 30 days and you choose to return it for a refund:
If the product is determined to be defective by our technical support services we will issue a Return Authorization number to you. Only SoundGate Technical Support Services will determine if a product is defective and will issue RA accordingly. Once received SoundGate will test the product for proper operation. If product is proven to be defective you may have full purchase price refunded (excluding shipping charges) or you may have the product replaced with working product. If product is proven to operate properly you may have the purchase price refunded (excluding shipping charges) less the standard SoundGate restocking fees or you may have the product returned to you.
- If the item is defective between 30 days and 1 year of receiving your order.
If your SoundGate product becomes defective or fails to operate properly after the 30 day return period and before the 1 year warranty expires you may return the product for replacement. To receive replacement product you will need to acquire the RA from SoundGate Technical Support Services and return the product with a copy of your original purchase receipt. If no receipt is included delays of up to 15 days will occur in processing and it will be left to SoundGate to determine if a replacement will be allowed. No refunds will be given after 30 days of order receipt.
- If the item doesn’t work as described:
If your SoundGate interface doesn’t operate as expressed by SoundGate in our literature or it doesn’t operate in your vehicle as our applications indicate / as recommended by SoundGate Technical Support Services, and you have record of recommendation, and it is discovered that product will not work for you SoundGate will accept the product for refund of full purchase price (excluding shipping charges) or exchange product for correct product if available. No restocking fee will be applied as long as product is returned in perfect condition with all original packaging. Any damage to device or missing packaging will be evaluated by SoundGate Returns Department and deducted from refund or exchange value at discretion of SoundGate.
- If you ordered the wrong item and wish refund:
If you purchased the incorrect SoundGate product because you misread, misapplied, or failed to read all application data, or have no records of the recommendation made by SoundGate Technical Support Services and wish to return product to SoundGate for a refund the standard restocking fee will be assessed, even if product is unopened.
- If you ordered the wrong item and wish to exchange it:
If you purchased the incorrect SoundGate product because you misread, misapplied, or failed to read all application data, or have no records of the recommendation made by SoundGate Technical Support Services and wish to exchange product SoundGate will accept product back into inventory with standard restocking fees applied to the returned product and exchange for new product. Value of returned product will be deducted from new product purchase price and customer is responsible for difference in charges for new product as if it were a new order.
SOUNDGATE reserves the right to refuse any refund and return the product to the customer if the item is determined to be damaged, unusable, or non resalable upon its return.
For any exchange or refund, we need the original receipt or a record of the purchase in our system, and the product must be in its original condition, including the box, UPC bar code, packaging, and all accessories.

Misc. Returns Information:
Missing accessories:
The value of missing items will be deducted from the credit amount of a return. For even exchanges, we will exchange what the customer returns (e.g., box for box, manual for manual, etc.)
Shipping returns:
You may return any merchandise purchased online using your preferred shipping method, provided that the return meets these guidelines.
Merchandise purchased online through soundgate.com, which meets the Refunds and Returns guidelines above, may be shipped to our authorized return center. Before returning anything to us, you first must obtain a Return Authorization ("RA"), found in the About Your Order section.
Any returns shipped to us without a pre-approved RA may be refused without notice, automatically returned and a handling fee assessed. An RA is valid for 10 days.
You will be responsible for all shipping and insurance charges for returns, unless otherwise indicated. If you choose not to insure your package, and we do not accept return of the Product, you will be responsible for any loss or damage. Upon our acceptance of the merchandise in like new condition in conformity with this policy, the purchase price will be credited to your credit card. Allow 7-10 days (not including delivery time for mail refunds) from when we accept your returned Product for the processing of your credit. Additional charges may be assessed for Products returned with any missing items such as manuals and/or accessories.

We make no warranty or guarantee that the information on our website is error-free, complete, or current. We also reserve the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.

We reserve the right to change Product pricing, terms, specifications and warranties without notice. In addition, we may revise these terms of use at any time by updating the website. Online sales are intended for, and limited to, personal use and domestic sales only. We reserve the right to limit the number of Products sold, including the right to prohibit sales to re-sellers. Prices do not include shipping, tax or insurance.
If you are purchasing Products for export, you are responsible for the necessary export documentation before shipment is made to a foreign country. We will not ship to foreign locations. Warranties for exported Products may vary or be null and void.

In no event shall SoundGate, its subsidiaries or affiliates, or their respective officers, directors, employees, representatives or agents be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to, loss of data, use, or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not we have been advised of the possibility of any such damages.

Governing law
These terms are governed and construed by the laws of the State of Oklahoma without regard to its conflict of law rules. You agree that if any part of these terms is found to be unenforceable, the remainder of these terms will remain in full force and effect.
